Dr Himanta Biswa Sarma who quit as Congress MLA from Jalukbari constituency is likely to face the anti defection law.
Assam Assembly Speaker Pranab Kumar Gogoi who received his letter on Tuesday will formally accept it on Wednesday when he will be in his office chamber.
Gogoi is expected to write to chief minister Tarun Gogoi seeking his comment as the Congress legislature party leader. Then he might seek legal opinion for a final conclusion.
According to constitutional experts, Dr Sarma is a fit case for anti-defection laws. Dr Sarma would have been spared had it been done before joining BJP. But Dr Sarma formally resigned 15 days after he joined BJP.
Initially, Dr Sarma left it on the Congress leadership. When the ruling kept silent he again decided to resign as MLA.
